Terms and Conditions

1. Acceptance of the Terms

These Terms and Conditions of Service (the "Terms" or the "Agreement") govern access to and use of Evolve (the "Application" or the "Service"), a mobile application dedicated to personal growth, habit tracking and emotional journaling, owned and operated by Simone Mattioli (the "Owner").

By downloading, installing, registering an account or using the Application in any way, the user (the "User" or "you") declares that they have read, understood and unconditionally agreed to be bound by these Terms, as well as by our Privacy Policy and Cookie Policy. If you do not fully accept these agreements, you are not authorised to download or use Evolve.

2. User Eligibility & Account Creation

The following operational conditions apply to the use of the Application and the associated services:

A. Minimum Age Requirements

The Application is intended for users who are at least 13 years old (or the minimum legal age for consent to the processing of personal data in their country of residence, e.g. 16 years in European Union countries under the GDPR). Users below the prescribed age may use the Service only under the direct supervision and with the explicit consent of a parent or legal guardian.

B. Registration and Credentials

Access to advanced features (such as cloud synchronisation) requires the creation of an account via email address or authorised third-party providers (Apple Sign-In or Google Sign-In) managed in encrypted form by Supabase Auth.

• The User undertakes to provide truthful, accurate and complete information.
• The User is solely responsible for the confidentiality of their credentials and for all activities carried out through their account.
• The Owner disclaims all liability for unauthorised access due to the User's fault or negligence in safeguarding their credentials.

3. Evolve Pro Subscriptions & Purchase Terms

Although Evolve offers a free basic plan, certain exclusive features (such as tracking unlimited habits, full access to the AI Coach, advanced correlation charts and custom themes) require a paid subscription named Evolve Pro.

A. In-App Purchases & Apple App Store Billing

All payments, billing, management and automatic renewals of Evolve Pro subscriptions are processed and handled entirely by Apple Inc. through the official App Store payment system (in-app purchases). Evolve does not receive, store or handle the User's financial details in any way.

B. Automatic Renewal and Cancellation

• The Evolve Pro subscription renews automatically at the end of each billing period (monthly or annual) at the rate in force at the time of purchase, unless the User turns off automatic renewal at least 24 hours before the end of the current period.
• The User may manage and cancel their subscription at any time directly from the settings of their Apple device (Manage Subscriptions under the Apple ID).

C. Refunds

Any refund request for the purchase of subscriptions or in-app purchases must be submitted exclusively to Apple through the official App Store support procedures ("Report a Problem"). Refunds will be approved and issued at Apple's discretion, in accordance with their terms of sale.

4. IMPORTANT DISCLAIMER: AI Coach Features

Evolve integrates an artificial intelligence system for the analysis of growth trends and motivational support (the "AI Coach"), based on transient processing provided by advanced LLM models.

5. Intellectual Property

All intellectual property rights relating to the Evolve Application — including, by way of example, the source code, the graphical interface (UI/UX), the logos, the iconography, the registered trademarks, the descriptive texts of the website and the software design — belong exclusively to the Owner Simone Mattioli and are protected by the copyright and industrial property laws in force in Italy and internationally.

Downloading the Application grants the User a limited, non-exclusive, non-transferable, revocable and personal licence to use the Service for strictly personal and non-commercial purposes. It is strictly prohibited to reproduce, reverse engineer, disassemble, modify or create derivative works from the Application.

6. Prohibited Conduct and Acceptable Use

The User undertakes to use Evolve lawfully and in compliance with these Terms. In particular, the User is absolutely prohibited from:

• Using automated systems (bots, crawlers, scrapers) to access the Service or extract data from the Supabase database.
• ATTEMPTING to circumvent or manipulate the Row Level Security (RLS) policies enabled on the Evolve database in order to access third-party data or compromise the isolation of the system.
• Uploading defamatory, obscene, harassing or unlawful content, or content that infringes the intellectual property of third parties, within the free-text areas of the app (e.g. goals, journal, chat).
• Using the app to distribute harmful software, viruses or malware.

7. Disclaimer and Limitations of Liability

THE EVOLVE APPLICATION AND ALL ITS CONTENTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT ANY WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

The Owner does not warrant that:

• Use of the app is entirely free from errors, network interruptions or system bugs.
• Synchronisation via the Supabase cloud is instantaneous under all mobile network conditions.
• The algorithm of the AI Coach or of the statistics calculation (Wellness vs Output) always produces infallible results or results suited to specific purposes.

To the maximum extent permitted by applicable law, the Owner shall in no event be liable for direct, indirect, incidental, special or consequential damages (including, by way of example, loss of data, interruption of work activity, physical or emotional distress) arising from the use of or the inability to use the Application.

8. Termination and User Withdrawal

The User has the right to withdraw from this Agreement at any time by ceasing to use the app and permanently deleting their account directly from the Evolve settings. Deletion of the profile entails the total and immediate removal of all user data from our Supabase servers (as specified in the Privacy Policy).

The Owner reserves the right to suspend or close the User's account, blocking access to the Application, in the event of a serious or repeated breach of these Terms or for technical national/international security requirements, without notice and without any obligation to refund.

9. Governing Law & Jurisdiction

These Terms and any dispute arising from the interpretation or performance of this Agreement shall be governed by and construed in accordance with the laws of the Italian Republic and of the European Union.

For any dispute between the Consumer User and the Owner, the competent court shall be that of the consumer's place of residence or domicile, in accordance with the protections of the Italian Consumer Code.
